The FDCPA stops debt collectors and attorneys from using undue harassment and other unethical practices when collecting on your debt. The FDCPA covers Personal, family, and household debts but not alimony or torts. Collection agencies may not misrepresent themselves. FDCPA also restricts contact to collection letters and phone calls.

The federal fair debt collection practices act is a law passed several years ago that spells out debtor rights during debt collection. Collectors must provide proof of the debt if requested (to avoid fraud), cannot call at work if you request it, cannot call after 9 PM or before 6AM.

The Fair Debt Collection Practices Act details the manner in which creditors can pursue means to collect a debt AND it spells out the rights of consumers. E. g. , a creditor/collection agent cannot threaten you, curse, etc. They can phone between 9 a. m. and 9 p. m. any day, but consumers can make a written request that calls stop.
