What are the copyright rules for VHS tapes?

Are they in public domain now?

No. VHS tapes are not at all in the public domain. Works are protected regardless of how they are contained, whether film, vhs or dvd for the life of the creator plus 70 years, or for a company at least 95 years. If you copy a VHS for anything other than person use, you are infringing the copyright.

Generally, works made for hire, such as movies, are protected for 95 years from the date published or 120 years from the date created, which ever is less. It doesn't matter what the storage format is.
