You are not eligible for workman's compensation in this situation, however you should be able to draw from your husbands social security. The first step is to contact your local social security office. The benefits you will receive is figured using your husbands work history. If you have children at home they too will receive a benefit amount each month.

No, you would probably not receive workman's compensation if your husband was killed on the job. You may have legal rights against the employer for your husband's death. You may also have life insurance at his employer that you were not aware of that you are the beneficiary of. Good luck.

If an employee dies while in the performance of his work related duties, and the cause of death is medically related to the employment, you will receive a worker's compensation award for permanent loss. This is normally paid out in a lump sum and often referred to as a survivor's benefit.
