When you are stopped for DWI, should you take a breath test or not?

You should take the test, even if you know you are over the legal limit. In many states you can be fined or jailed for refusal to take a breathalyzer test, and refusing the test is no guarantee that you won't be convicted anyway based on the officer's observations, a field sobriety test, and other evidence.

Don't drink and drive. If you are pulled over and have had some to drink take the test. If you are really drunk, you may want the later blood test.

It's implied when issued your license that you have given your consent for this test. If you refuse, legally they can draw blood or just find you guilty w/o trial.

If you refuse any of the tests to determine blood alcohol, you more or less incriminate yourself to the fullest extent as guilt is presumed relative to the BA level.
