When does a landlord need to paint an apartment?

My apartment has not been painted in the five years I have lived here.

Unless your lease agreement states otherwise, a landlord only has to has to paint often enough to keep the premises habitable. Habitable means that it is a safe environment for a person to live it in. Just because the paint is old doesn't mean that it is uninhabitable. Many states do, however, require lead paint removal.

Unless specified in your lease, the landlord is not required to paint an apartment. You may ask the landlord if you can paint and deduct the cost from your rent.

You need to ask him in writing. Perhaps he does realize that it's time. Try taking a picture which shows the need for the paint and make some suggestion where he can find some cheap paint.
