Evidence can be excluded if it is overly prejudicial or if it's not relevant to an issue in dispute. In criminal cases, evidence is excluded if improperly obtained.

The judge makes decisions with regard to the law that governs rules of evidence. The laws are complex and consider when, where, how, why and if specific things are brought into evidence. If evidence is allowed in violation, the judge's decision in the case will likely be overturned on appeal.
