What is some information on the Canadian extradition treaty?

Basically, in layman's terms, America has an agreement that American criminals hiding in Canada and Candian criminals hiding in America will be returned to their country of origin if caught. The only exception is if you can prove you would face an unfair trial in your country of origin. You can still be tried in Canadian court however.

Canada rewrote its extradition laws in 1999 to "prevent Canada from becoming a safe haven for criminals. " The new laws are complex and involve international law and a boatload of treaties. Fugitives are extradited for prosecution, sentencing and/or to serve an imposed sentence.

The treaty was signed in 1974. The two governments agree to transfer fugitive criminals back to the jurisdiction of the charges.

As of 2007, Interpol listed Canada has having extradition treaties with 47 countries. Each treaty is specific to the country with whom it is made. Canada will only extradite foreigners; that it, it will not extradite Canadians to stand trial in another country.

Extradition treaties are between two countries. They are not blanket policy statements. Canada may have an extradition agreement with the U.S. but not with China, for example. To examine a particular agreement Canada may have, you must know the other country that is party to the agreement/treaty.
