Technically there is no such term. Prosecution can occur for those who refuse such things as breath tests, uncooperative witnesses, etc. There is also a term "refusal TO prosecute".
Refusal of prosecution is the District Attorney's legal wording for not bringing a case forward to the court. However, this does not mean the same as dismissing a case.
