Before you file a complaint at your local police department, you must have some type of proof of abuse, a taped phone message, a bruise, or note. This is to show them you fear for your safety once you have proof they will file the proper papers.

The rules for getting a restraining order vary from state to state. In general, it involves filling out a form which should be available at any courthouse and explaining why it is needed. A judge will then review it and decide whether or not to grant the order. The details will vary among different states.

File an application in the correct court-family or district. The $15 filing fee can be waived, if the court finds in your favor-you need to sign a fee waiver with the cashier. You will be assigned a court date. If offender doesn't show, you win by default.

This is a legal procedure, so it cannot be carried out by a layperson on his or her own. You must hire a lawyer, who will file the necessary paperwork.
