What are the gas and oil rights in PA?

The property owner holds the rights to gass/oil/minerals on/below/within the land. S/he may opt to contract with a commercial entity to let those rights. The details of the agreement, like the extent and term of the rights, would be spelled out within the contract and, as such, be subject to contract law in the event of a dispute.

Pennsylvania law states that a property that has underground mineral deposits, could have two titles of ownership: one for the surface and one for the minerals. Under state law, mineral owners must be afforded reasonable access for drilling and capturing gas or oil on the property, by the surface owner. Additionally, they can collect royalties, by allowing producers to drill.

Generally, the owner of a tract of land has the right to the gas and oil that lies directly beneath that land. Most landowners do not have the capacity to access gas/oil below the surface, and so contract with gas/oil companies who do. The details of the contract then apply with regard to payment, duration, etc.
