Most judges will take into consideration the wishes of a minor child over the age of ten. Before this the courts usualy make the decision themselves.

The rules for this vary by state. In most states, though, the child's preference is just one of several factors that the court considers.

Ultimately the judge in the child custody hearing will make the final decision. His decision will depend on the age of the child and what in the judge's opinion is in the best interests of the child. The older the child is, the better.

It really depends on the judge. It varies from judge to judge. Some judges will set an age and some judges will revisit the option periodically. You need to make sure one of your parents knows you have an opinion.

Children are not allowed to choose their option of living with father or mother, if they are below 7 years old. But it differs from state to state. It is easier for the children to take decision with whom they live without justifying environments. It is given importance to those children who have completed 7 years to choose their option.
