You would file with the lowest court of general jurisdiction in your state. Small claims courts are specialized courts that have limited jurisdiction, but general jurisdiction courts can hear all claims based on state law.

You'd go to a regular court if potential damages for a feasible case could results in something over $7,500. The name of that court varies among the states, but generally speaking, it's called a trial court.

You file in the same court, but it becomes a civil issue. The difference is in that it is not adjudicated as quickly, there are not simple rules to decide. It may go before a jury or be adjudicated before the judge,- it may become a criminal issue as opposed to a a civil dispute.

Small Claim Court is quick, easy, inexpensive to file and can be handled without an attorney. For larger claims, file in a higher court, which adds legal and filing fees. Weigh both options. The small claims limit varies from state to state.

Small claims courts are known as a court of limited jurisdiction. Claims that do not qualify for small claims courts are heard in a court of general jurisdiction.

When the amount you are seeking exceeds the limit for a small claims lawsuit, you can file a claim in your local county court system. At this level, it is recommended that you seek legal representation.
