My divorce papers say I can't move my son out of state. How do I get this changed?

A family court judge will make a decision on this issue. The only reason that usually works is that you need to move to another state to make a living.

Your son has a right to a relationship with both parents, which is hampered if you move. BOTH parents and the court must agree to the move, and you must be responsible for all expenses related to frequent visits as agreed.

The rules for this vary greatly from state to state, and you should talk to an attorney licensed to practice in your state. These requirements are actually quite common, and often difficult to change without your ex-spouse's consent. Usually, a judge must agree to let it happen.

Unless the other parent agrees that you would be able to move you would have to go before a judge who would determine if you could do it . Most likely he would give the ok, if you agree to let the child stay with the other parent so many months out of the year.

You can file a request for a change in custody and visitation that will allow you to move out of state. You must have a compelling reason to move, such as following a job when none exist where you are or moving back in with your parents.
