If you tape over the phone,it is illegal, but if you tape without consent in a public place it is legal. The problem is, these conversations cannot be used in court. You have to be careful taping conversations in private places like your home because in most places that is illegal.

Under Florida law, you can legally record a conversation if the other person doesn't expect it to be private, and you can legally record a normal business telephone conversation. However, it is illegal in Florida to record other types of electronic conversations without the permission of everyone participating in the conversation.
