Most states frown on private citizens having a scanner. In some states it is illegal but if you live somewhere where it is not you may use it. But be discreet with your usage and not draw attention to yourself.
In nearly all jurisdictions it is legal to possess a police scanner. Many journalists have them in their homes so as to stay on top of local police reports. It's actually quite interesting to listen to the police bands.
