If my neighbor has built a backyard shed which extends over my property by more than 12 inches and he refuses to move it may I get a judgment against him that protects my rights to exclusive use of my own property?

If after a measurement it is determined that your neighbor has truly gone over the property line, you can get an injunction from a judge to have the shed moved.

First thing you need to do is get your property surveyed... because often where the perceived property line is (i. e. tree line, fence, etc. ) isn't the legal line. After getting it surveyed and it is on your property line, I'd speak with your local city.

Rules and regulations differ in every state. Contact your local county clerk's office for information on what you can do and what your options are in this case. If you don't follow proper procedure you may not get the result you're looking for.
