How old does a child in Kentucky need to be to decide with whom s/he wants to live?

My son is 9 and doesn't want to live with his mother anymore.

The court decides what is best for the child with consideration to a solid position that all kids need to have a relationship with both parents. A 9-yr old is not capable of deciding with whom it is best to live. A parent or concerned person can petition the court if there is evidence of abuse/neglect, etc.

The court grants custody based on what best serves the child. A 9-year-old doesn't know what is best. If the non-custodial parent can show reason (abuse, addiction, neglect, etc.) that the current situation is not in the child's best interest, options will be considered. The court likely wouldn't consider a child's input before age fourteen, depending on maturity.

Generally, children never get to decide with which parent they live. Their opinion is listened to by a guardian ad litem(an attorney that represents the best interests of the child) who conveys to the court the childs wishes and what they believe is in the best interest of the child. Late teenagers opinions are heavily weighed.
