How do you go about filing a motion in the state of California?

Go to the Clerk's office in the court where the case is filed. Ask for the forms to file a motion. Take along contact info for parties to be notified.

Go to the Clerk's Office in the appropriate Court. Tell the attendant that you do not have an attorney and you want to file a motion. You will fill out fairly simple forms that include the names and addresses of others as needed, and the nature of your motion. You will be told when to appear for the motion hearing.

First, is this a civil or criminal motion? In most cases, you can contact your local district court clerk who can provide you with the appropriate forms and aid you in setting it for the docket. However, they cannot give you any legal advice.

In LA Superior Court call the court clerk in the department your case is pending in and request a motion hearing date. Draft and serve the Motion papers on the opposing party 16 court days prior to the hearing date plus time for mailing. File the originals with the court.

You will need to fill out all of the proper paperwork first. Be sure to be extremly accurate in doing this as they are legal doccuments. Next, you will need to file them with the clerks office and you usally will pay your filing fees at this time. Once your motion has been filed you will recieve your court date.
