Can the homeowners association charge you to rent your condo?

It depends on the homeowners association and it's bylaws and rules. Many HOAs do charge a fee for a property that is rented. The fee is usually a percent of the rent the owner is receiving.

They may not charge you if *you* rent your condo (find a renter and handle it yourself). However, they may charge you if you ask them to rent it out for you, handle the paperwork, collect the rent and communicate with the renter. You are still responsible for HOA fees, which you should calculate into the cost of the rent.

Depending on how the association's bylaws are written, they may be able to assess a fee for rentals. This is particularly common in places like Florida where people keep condos but do not occupy them year-round. A fee is assessed by the HOA. Usually it is a percentage of the rental amount.

Condo HOA's can charge the landlord extra fees for rentals of their property depending on the jurisdiction and way the covenants are written. It sounds like the landlord is passing on the charges directly to you. Ultimately however the HOA binds the registered homeowner, while the lease may bind you to pay them, the owner is legally responsibile.

It would have to be clearly stated in your homeowners association agreement, but they can charge you to rent your condo if it is outlined there.
