Can my husband's drug use be used as grounds for divorce, and how does it affect custody decisions?

If the drug use is causing hardship, that is an issue that can be used for divorce. Petition the court for sole custody if drugs renders him an unfit parent.

Divorce laws vary by state; in some, it would be and in others not. Most custody decisions look at what will be in the best interest of the child.

The answer is yes to both questions. When custody is decided, it is more than likely that the non-drug using parent will receive custody. A judge is required to put the welfare of a child first.

As far as I am aware, It can be used as grounds for both devorce and leverage in custody battles, I do not believe that proof of physical or mental abuse is neccesary in this sort of case, however, as with any domestic law, it varies from state-to-state.

Yes.You can site this as a cause.Your husband is under the control of drugs,it means that his reasoning capacity is low.So it will affect custody decision.

Drug use can be a basis for divorce in most states. If he is still using or has used recently, he can be denied any visitation that is unsupervised. Consult an attorney.

that would have to be in the visitation agreement part about the drug test, he would have no reason to submit one to you, unless it is in the visitation and custody agreement
