Can I rescind a severance package offer?

I do not think my severance package offer was fair, can I rescind it and negotiate?

You can reject the offer, especially if you have not signed any paperwork yet. The company probably has a standard severance package in place, but you can still negotiate. Make sure you have a good argument of why you think their first offer was unfair but also be prepared for them to reject your counter offer.

You need to read all the fine print on your copy of the severance agreement. You should have signed a document that states exactly what you agreed to and if/how that agreement can be modified.

A severance agreement can be rescinded within a given window specified in you document, usually seven days. Negotiation will generally not yield extra benefits as corporations must apply consistent rules to avoid the appearance of discrimination. You would however clear yourself of the waivers in the agreement therefore crating a clearer path if you choose to bring a law suite.

Severance packages are offered to employees the company is no longer keeping. It is usually based on years of service. You may be able to contact Human Resources and make a case for longer medical coverage or lower tax withholding. You cannot negotiate getting more severance money. If you have cashed the check, you cannot negotiate at all.
