Can an employer in Minnesota withhold my pay because I forgot to clock in?

They can decline to pay for time you cannot prove you were there. But if there is proof you were present such as computer access logs, door access logs, sales logs for which you handled customers, or even emails sent using your work email during the time frame you were present can prove you were there.

The employer can refuse to pay you for time you did not prove worked by not clocking in. However, if there is proof of time worked, it should be paid.

Yes and no. He must pay you for all times you were clocked in, regardless of whether or not you clocked in one day. He does NOT have to pay you for time you did not clock in during unless you have another means of proving that you were at work.

No, they cannot. If you have witnesses that you were on the premises, they must pay you for the time worked. The employer can restrict pay to the verifiable time.

i live in kentucky and here, all you have to do is let your supervisor know that you forgot to clock in and they manually fix it. i forget to clock in at least once or twice a month and i've never had my pay withheld. i would think that would be the case in minnesota as well.

No, any employer in the U.S. is legally suppose to pay you for any hours you have worked. They should have to pay you next payday for all hours worked.

Your employer must pay you if you can prove that you were working during the hours in quesion. If you can't prove it, the employer has no obligation to pay you.
